Under-Insured Motorist Claims

An Underinsured Motorist Claim can be brought when the at fault driver is insured, but has less insurance than you, and your case is worth more than the amount of liability insurance the at fault driver has. In this type of case, the initial claim is brought against the at fault driver and after its insurance company pays its policy limit, you can bring the UIM BI case against your own insurance company. They have to “stand in the shoes” of the underinsured negligent driver.
